Local Media Access

If you choose to load local media (e.g., MV-HEVC videos), the app may request access to your Photos library.

  • Media access is local to your device.

  • We do not upload or transmit your personal media.

  • We do not scan or store your photos or videos.

Audio Playback

We use Apple frameworks (such as AVFoundation and related spatial audio technologies) for immersive audio playback.

  • No audio is recorded from your device.

  • No microphone data is collected unless explicitly required by a feature and approved by you.

AR & Spatial Features (LALÒ Companion)

AR features may use your device camera and motion sensors to render spatial previews.

  • Camera data is processed in real time on your device.

  • We do not record, store, or transmit camera imagery.

D. Subscriptions & In-App Purchases

Subscriptions and purchases are processed through Apple’s App Store.

We do not receive:

  • Credit card numbers

  • Billing information

  • Apple ID credentials

Apple may provide us with limited transactional information necessary to confirm subscription status.

E. External Links

Our apps may link to third-party platforms, such as:

  • Ticketing services

  • Donation platforms

These Terms of Use (“Terms”) govern your access to and use of:

  • LALÒ Immersive (Apple Vision Pro application)

  • LALÒ Companion (iPhone application)

(collectively, the “Apps”), operated by LALÒ Ensemble (“LALÒ,” “we,” “our,” or “us”).

By downloading, installing, accessing, or using the Apps, you agree to be bound by these Terms. If you do not agree, do not use the Apps.

1. Description of Services

The Apps provide digital access to:

  • Apple Immersive Video, 180, 360, spatial and 2D performances

  • Spatial and stereo audio recordings

  • Choral works and premieres

  • Behind-the-scenes content

  • Augmented reality (AR) venue previews

  • Event listings and updates

  • Subscription-based premium content

Features, content, and functionality may change at any time without notice.

We do not guarantee availability of any specific performance, immersive release, or feature.

2. Eligibility

You must:

  • Be at least 13 years old (or the minimum age in your jurisdiction)

  • Have the legal capacity to enter into these Terms

  • Comply with all applicable laws

If under 18, you must have permission from a parent or legal guardian.

3. Accounts, Subscriptions & Payments

Certain features may require:

  • An Apple ID

  • An active subscription

  • In-app purchases

All payments are processed through Apple’s App Store.

Subscription Terms

  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the billing period.

  • You may manage or cancel subscriptions through your Apple account settings.

  • LALÒ does not control Apple’s billing system and cannot issue refunds directly.

  • Refunds, if any, are governed by Apple’s policies.

Subscriptions grant a limited license to access premium features during the active subscription period.

They do not grant permanent ownership of digital content.

4. Service Availability & Discontinuation

LALÒ Immersive and LALÒ Companion are evolving digital services.

We reserve the right to:

  • Modify, suspend, or discontinue the Apps or any feature

  • Remove, replace, or update immersive content

  • Change subscription offerings or pricing

  • Transition to new platforms or technologies

  • Cease operations of the Apps entirely

We do not guarantee:

  • Continuous or uninterrupted availability

  • Perpetual access to any specific performance or feature

  • Ongoing support for any device or operating system

If paid services are permanently discontinued:

  • Active subscriptions will not renew

  • Access may end at the conclusion of the current billing cycle

  • No additional charges will occur after discontinuation

Refunds are subject to Apple’s App Store policies.

Access to the Apps constitutes a license to use the service while available. It does not create a right to lifetime access.

5. Intellectual Property

All content within the Apps is owned by or licensed to LALÒ Ensemble, Miggi Angangco, Paolo Villanueva, GP Eleria, Jemmerson Canaya and protected by copyright, trademark, and intellectual property laws.

This includes:

  • Video Recordings

  • Spatial audio mixes

  • Musical compositions and arrangements

  • Live performances

  • Visual environments and AR spaces

  • Software, UI design, and branding

You may not:

  • Record immersive experiences

  • Capture, extract, or redistribute audio or video

  • Reproduce or publicly perform content

  • Reverse engineer the Apps

  • Create derivative works

  • Use content for commercial purposes

Unauthorized recording or distribution of immersive performances is strictly prohibited.

6. Immersive & AR Use; Physical Safety

The Apps include immersive and augmented reality features.

By using them, you acknowledge:

  • You are responsible for ensuring a safe physical environment

  • You will remain aware of your surroundings

  • LALÒ is not responsible for injuries, collisions, falls, or property damage resulting from device usage

  • Rendering and performance may vary by device capability

Use of AR features may require camera and motion sensor access. Such data is processed locally on your device.

7. Acceptable Use

You agree not to:

  • Use the Apps for unlawful purposes

  • Attempt to bypass subscription restrictions

  • Interfere with servers or infrastructure

  • Share account credentials

  • Use scraping, automation, or extraction tools

  • Attempt to access restricted content

We may suspend or terminate access for violations.

8. Third-Party Services

The Apps may integrate with or link to:

  • Apple services

  • Streaming platforms

  • Ticketing services

  • Donation platforms

We are not responsible for third-party services or their policies.

Apple Inc. is not responsible for the Apps’ content, maintenance, or support.

9. Disclaimer of Warranties

The Apps are provided “as is” and “as available.”

We make no warranties regarding:

  • Uninterrupted service

  • Error-free operation

  • Compatibility with all devices

  • Satisfaction of subjective expectations

Use of the Apps is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, LALÒ shall not be liable for:

  • Indirect or consequential damages

  • Loss of data

  • Loss of profits

  • Subscription interruptions caused by third parties

  • Device-related injuries

  • Platform-level disruptions

Our total liability shall not exceed the amount paid by you for the Apps within the preceding 12 months.

11. Force Majeure

LALÒ shall not be liable for failure to perform due to circumstances beyond our reasonable control, including but not limited to:

  • Platform or API changes

  • Hosting disruptions

  • Government action

  • Natural disasters

  • Financial insolvency

  • Technical failures

12. Termination

We may suspend or terminate your access if you violate these Terms.

You may discontinue use at any time.

Sections concerning intellectual property, liability, and governing law survive termination.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes shall be resolved in courts located in California.

14. Changes to These Terms

We may update these Terms periodically.

Updated Terms will include a revised Effective Date.

Continued use of the Apps after changes constitutes acceptance of the revised Terms.
